These Terms & Conditions govern access to and use of the Gusto website and yacht racing crew coordination application. By using Gusto, you agree to these terms.

1. Accounts

Gusto is invitation-only. You must provide accurate information, keep it current, protect your credentials and report suspected unauthorised access. You are responsible for activity through your account.

2. Gusto’s role

Gusto provides coordination tools. Organisers—not Gusto—make crew-selection, position-assignment, scheduling and participation decisions. Opting in indicates availability but does not guarantee selection.

3. Safety and qualifications

Gusto does not provide sailing, medical, safety or legal advice and does not verify that a person, certificate or item of equipment is suitable. Users and organisers remain responsible for safety, compliance, qualifications, fitness and equipment.

4. Acceptable use

You must not interfere with Gusto, seek unauthorised access, upload malicious material, impersonate others, infringe rights, scrape the service or use other users’ information for unrelated purposes.

5. Your content

You retain ownership of content you submit and grant Gusto a limited licence to host, process, display and transmit it as needed to operate the service. You confirm you have the right to provide that content.

6. Availability and changes

We may modify, maintain, suspend or discontinue features. We aim to provide a reliable service but cannot guarantee uninterrupted or error-free access.

7. Intellectual property

Gusto’s software, branding, design and original content are owned by or licensed to the service operator and protected by applicable intellectual-property laws.

8. Suspension and termination

We may restrict access following a breach, security threat, organisation request, or legal or operational risk. You may stop using Gusto and request account deletion at any time.

9. Liability

To the extent permitted by law, Gusto is provided “as is” and “as available.” Nothing excludes rights that cannot lawfully be excluded, including applicable Australian Consumer Law rights. To the extent permitted by law, we are not liable for indirect or consequential loss from use of Gusto or reliance on organiser-supplied information.

10. Privacy, changes and contact

Our Privacy Policy explains how personal information is handled. We may update these terms and will publish the revised date here. Questions can be sent through the Gusto contact form.
